This Site and all Content are the copyrighted property of Bhaarathi Digital Printerss, and/or its subsidiaries (referred to herein as “Bhaarathi Digital Printerss”) or the copyrighted property of parties from whom Bhaarathi Digital Printerss has licensed such property. All rights in this Site and its Content are reserved worldwide. It is strictly prohibited to retain, copy, distribute, publish, or use any portion of the Content except as expressly allowed in these Terms of Use.

 

Bhaarathi Digital Printerss reserves the right to add to, delete from, or modify any part of Content at any time without prior notice. Bhaarathi Digital Printerss provides no warranty of any kind that logo designs created using the design tools will not infringe, or be subject to a claim of infringing, the trademark or other rights of another party. It is solely your responsibility to obtain the advice of an attorney regarding whether the logo design is legally available for your use and does not infringe the rights of another party.

USE OF SITE

 

You are granted permission to access and use this Site and its Content for the sole purpose of preparing, evaluating, and ordering products or services solely through Bhaarathi Digital Printerss (referred to herein as “Products”). No other download, retention, use, publication, or distribution of any portion of the Content is authorized or permitted. Obtaining Products from Bhaarathi Digital Printerss does not entitle you to use any portion of Content apart from the finished Products as they are supplied by Bhaarathi Digital Printerss.

You agree to use this Site in a responsible manner that is in full compliance with these Terms of Use and with your local laws and regulations, including export and import regulations. Without limitation, no portion of Content may be utilized as a trademark or service mark, for any pornographic use, for any unlawful purpose or use, to defame any person, to violate any person’s right of privacy or publicity, to infringe upon any copyright, trade name, trademark, service mark or other intellectual property right of any person or entity. You agree that you will not use the Site to produce Products that are offensive, unlawful, harassing, libelous, threatening, harmful, obscene, malicious or otherwise objectionable. Bhaarathi Digital Printerss may terminate its service to customers found to be using Bhaarathi Digital Printerss to engage in undesirable activities.

You are solely responsible for your use of Content in combination with any other images, graphics, text or other materials you incorporate into your Products. You agree that you will not include any text, image, design, trademark, service mark, or any copyrighted work of any third party in your Products unless you have obtained the appropriate authorizations from the owners. You warrant that your Products do not infringe upon any rights of any third party, including copyright, trademark, right of publicity or privacy, and will not libel or defame any third party, and that you have all required rights or permissions necessary to incorporate third party material into your Products. By placing an order on this Site, you warrant that you have all necessary permission, right and authority to place the order and you authorize Bhaarathi Digital Printerss to produce the Products on your behalf.

You may not use this Site to send or use e-cards in any manner that would constitute the transmission of Spam or unsolicited e-mails. You may not use scripting or other programs to automate the creation and/or transmission of e-cards. Bhaarathi Digital Printerss reserves the right, in its sole discretion, at any time, and without prior notice, to limit the number of recipients to which you may send an e-card and/or limit the number of e-cards that you may send. You agree that you are responsible for protecting your password and controlling access to your registered account. You agree that you will be responsible for all orders placed or other actions that are taken through your registered account.

SECURITY

 

www.bhaarathidigitalprinters.com website ("Website") is an Internet based content and e-commerce portal, an entity established under the laws of India. Use of the Website is offered to you conditioned on acceptance without modification of all the terms, conditions and notices contained in these Terms, as may be posted on the Website from time to time..

 

USER ACCOUNT, PASSWORD, AND SECURITY

 

You will receive a password and account designation upon completing the Website's registration process. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account. You agree to immediately notify Bhaarathi Digital Printerss of any unauthorized use of your password or account or any other breach of security, and ensure that you exit from your account at the end of each session. Bhaarathi Digital Printerss cannot and will not be liable for any loss or damage arising from your failure to comply with this Section.

PRIVACY POLICY

 

The User hereby consents, expresses and agrees that he has read and fully understands the Privacy Policy of Bhaarathi Digital Printerss Website. The user further consents that the terms and contents of such Privacy Policy are acceptable to him.

 

PRINTING ERROR RESOLUTION

 

Bhaarathi Digital Printerss does not check any submission for spelling, grammar, or any other errors. The design will be printed as it appears during the approval step. It is your responsibility to ensure that all materials submitted for printing are formatted correctly.

STANDARD FILE REVIEW

​

Before you approve file for printing, make sure that your design does not have errors prior to print that will result in a bad print product. Our file specialists will review files for the following common errors (but ultimate responsibility to check such errors is yours):

• Full bleed

• Text and content out of zone

• Spot UV alignment

​

Other errors our file specialists will not check for include but are not limited to the following:

• Spelling Errors and typos

• Colour out of gamut

 

DECLINE FILE REVIEW

 

If you decline the file review service, the design will be printed as it appears during the approval step. It is your sole responsibility to ensure that all materials submitted for printing are formatted correctly.

LIMITED WARRANTY FOR PRODUCTS ORDERED

 

Bhaarathi Digital Printerss guarantees prints you order and pay for will be in accordance with CMYK industry standards for pleasing colour. We offer no guarantee of "match-print" colour fidelity and cannot prevent slight colour shift throughout an order. Bhaarathi Digital Printerss does not guarantee colour will match the preview as it appears on a customer's monitor, because monitor colours vary. Bhaarathi Digital Printerss is not responsible for any colour shift that occurs in conversions from RGB to CMYK colour modes. We recommend all custom designs be designed in CMYK and uploaded in CMYK. You may also upload in RGB if you choose, but the colour will be converted to CMYK and may not be accurate. If you do upload in CMYK, we ask you to design using our preferred colour profile for better colour accuracy.

Orders will not be defective due to printing errors, coating errors, cutting errors, or bindery errors if they were designed within Bhaarathi Digital Printerss design specifications. You may not be able to print or write on the product after purchase. Bhaarathi Digital Printerss' products are often coated and can be difficult to print on. UV coated products cannot be printed on while matt covered products may require commercial printers. Satin matte finish allows for easier write ability compared to our UV gloss finish. It is your responsibility to test using a sample and verify that your printer or pen will work before placing an order. Samples can be ordered online for free.

Bhaarathi Digital Printerss cannot be held responsible for un-usable QR codes and /or Microsoft Tags after print. Please test the code with the application before file submission. Immediately upon receipt you should inspect all Products to ensure there are no defects and that the order is complete. If a print is found to be defective, Bhaarathi Digital Printerss require fanned out photos to show a sampling of the defective product from the front, middle, and end of the package(s) prior to taking any action.

The foregoing warranty does not include defects due to customer errors, such as incorrect file submission in accordance with our specifications, duplicate orders, customer misunderstandings of turnaround time, slight colour variances within four colour (CMYK) industry standards for pleasing colour, disregard for cutting and folding tolerances within stated limits on the website, incorrect paper, cover stocks and coating options chosen for print, undelivered packages / 3rd delivery attempts or refusal or delivery and orders returned without an RMA. No compensation is offered for any of the above or below items.

DETAILS CONCERNING COLOUR REPRODUCTION

 

Gang-Run Printing refers to the specialization in supplying customers with affordable four-color printing. Utilizing this method known as "Gang-Running", combines your short-run jobs with others having similar requirements. This allows the initial production costs to be spread out over several jobs, greatly reducing the make-ready charges for each customer. All work is carried out by skilled professionals on state-of-the-art equipment to assure you quality work at affordable prices.

BUT GANG RUN PRINTING HAS ITS LIMITATIONS...

 

Because of limitations with the Gang-Run printing process, as well as neighboring image ink requirements, the accuracy of colour reproduction is not guaranteed. By placing and order with us you agree to this limitation. We accept no responsibility for colour variations between submitted files and the final printed piece. Under no circumstances will a reprint be honored for colour variations that have occurred during the printing process.

​

We will show you an online proof of your job shortly after receiving it in our production department, but actual time will vary depending on our current workload. No job will be sent to press without your approval, so please reply as quickly as possible. Please take note that an online proof is by no means an accurate colour reproduction of your final printed piece but is a final opportunity for you to check the layout, bleeds, crops and final text. If you determine that you need to submit new files after we have shown you an online proof, you can do so by replying to the email we sent to you with your proofs. You will be instructed on how to re upload your files.

​

By the time your job gets in our hands and we are ready to go to print, all edits should be finalized, the copy carefully proofread and all design issues should be settled. We will not take responsibility for any copy or design errors committed on your part. We are also not responsible for any wrong dates or misspelled words in files submitted by customer or jobs approved by customer upon design completion.

MAILING SERVICES

 

All prices are quoted based on the following general terms and conditions, unless specifically stated otherwise in the written quotation. Prices quoted are based on our understanding of the job specifications given at the time of the request for quotation and are subject to review when pieces have been received. To avoid any misunderstanding, and to ensure that all customer work is processed in an orderly manner, all mailing services instructions should be in writing. Instructions not provided in writing may lead to problems for which we cannot be responsible.

 

SHIPPING

 

Bhaarathi Digital Printerss will arrange for shipping with a reputed carrier. Bhaarathi Digital Printerss will not be responsible for the delay in delivery, loss while the order is with the shipping carrier.

DEFECTIVE PRODUCTS

 

Bhaarathi Digital Printerss must be contacted via e-mail at sales@mayilbrand.in  or by phone at  04364 220640 | 98430 86460 | 93 60 660 325 within 7 days of receiving your order. Bhaarathi Digital Printerss require fanned out photos to show a sampling of the defective product from the front, middle, and end of the package(s) prior to taking any action.

If the product is not deemed defective, and customer chooses to keep the product, Bhaarathi Digital Printerss can issue a 50% store credit for the product cost towards a future order. If the product is deemed defective, and of Bhaarathi Digital Printerss error, we will reprint the order with the same delivery terms ordered.

​

Since each order is custom made to customer and has no re-sale value, All Sales Are Final. Full refunds are only authorized with a Return Merchandise Authorization (RMA) Label based on Manager Discretion. Bhaarathi Digital Printerss will issue an Order number so the defective product can be returned for a full refund, but Bhaarathi Digital Printerss is not responsible for added pick-up or service fees. Orders that are returned without prior authorization will not be eligible for compensation. All authorized RMAs will go through a Quality Control check prior to the compensation being issued. All defective merchandise, including any and all reprints of the defective set(s) must be returned with an RMA in order to receive a full refund on the defective product ordered.

Bhaarathi Digital Printerss does not offer any compensation for customer errors under Limited Warranty for Products Ordered.

MISCELLANEOUS

 

These Terms of Service are not assignable or transferable by you without the prior written consent of Bhaarathi Digital Printerss. These Terms of Service (including all of the policies and other Agreements described in this Terms of Service, which are incorporated herein by this reference) contain the entire understanding of the parties regarding its subject matter, and supersedes all prior and contemporaneous agreements and understandings between the parties regarding its subject matter. No failure or delay by a party in exercising any right, power or privilege will operate as a waiver thereof, nor will any single or partial exercise of any right, power or privilege preclude any other or further exercise thereof or the exercise of any other such right, power, or privilege. You and Bhaarathi Digital Printerss are independent contractors, and no agency, partnership, joint venture, or employee-employer relationship is intended or created by these Terms of Service.

You agree to receive promotional, transactional and commercial communications from Bhaarathi Digital Printerss through email or SMS.
